its Supreme Court and Appellate Litigation practice, resident in

Mark spent seven years on the Appellate Staff of the Department of
Justice's Civil Division where he argued more than two dozen cases in
the federal courts of appeals, including numerous matters for the Patent
and Trademark Office, the Copyright Office and the Federal
Communications Commission. Over time, Mark developed a proficiency in
intellectual property law, representing the government in several of the
biggest patent cases including two en banc appeals - Festo Corp. v. SMC, Corp. and Southco v. Kanebridge.

the chair a 70-member subcommittee of the American Intellectual
Property Law Association and on various other committees of the major
patent bar associations. He received his J.D. from the University of
Chicago, with honors, in 1995 and his B.A., cum laude, from Yale
University in 1992. Mark clerked for Hon. Karen LeCraft Henderson on
the U.S. Court of Appeals for the D.C. Circuit.

Alyssa A. Grikscheit Joins Sidley Austin LLP as a Partner in New York

New York – Sidley Austin LLP announced today that Alyssa A.
Grikscheit has joined Sidley as a partner in the Latin America and
investment funds, advisers and derivatives practices. She will be based
in the New York office and will focus on cross-border transactions and
alternative investment funds.
Ms. Grikscheit has significant
experience representing clients in Latin American, emerging market and
other cross-border transactions, including M&A, joint ventures and
fund formation. She has represented companies and private equity funds
in the negotiation and execution of mergers, acquisitions, joint
ventures and strategic alliances, and has represented sponsors in the
formation of investment funds, particularly those involving cross-border
investment or alternative assets.
"Alyssa brings considerable
experience in cross-border transactions in emerging and developed
markets and fund formation, particularly for funds involving
international investments and alternative asset classes,” said Carlos A.

At a signing ceremony Wednesday in Zurich, pharmaceutical giant
Novartis finally closed a deal to take over a 77 percent stake in
eyecare company Alcon held by Nestle. Novartis's quest had started
two-and-a-half years ago, and the midweek event marked a big win for the
company.
Since setting its sight on Alcon in 2008, about $40 billion in cash
has changed hands between Novartis and Nestle. Currently, another $11
billion is on the table in Novartis's merger bid for a remaining 23
percent stake held by Alcon's minority shareholders. If Novartis
succeeds at acquiring those remaining shares, as is expected, it is
likely to become the largest merger in Swiss history, say lawyers
involved in the deal. And it will mark another milestone, too, becoming
one of the biggest buyouts in history, according to Dealogic. (The next-largest, according to Dealogic, was the $32.6 billion deal for Canadian telecom company BCE.)
The outcome may be uncertain, but so far Novartis's Swiss and U.S.
lawyers have maneuvered smartly to maximize their clients position. The
person directing those maneuvers and responsible for the structure of
the Nestle share purchase is Allen & Overy's Eric Shube.

FKSA successfully represented a pro bono
client who is a refugee from Côte D'Ivoire in seeking asylum in the
United States. In Côte D'Ivoire, the client had suffered multiple
beatings on account of his Dioula ethnic background and his
participation in a political rally protesting the Ivorian government.
The client's affirmative application for asylum and other relief
initially was denied by the Immigration Judge, and that ruling was
affirmed by the Board of Immigration Appeals. The client then
appealed to the United States Court of Appeals for the Second Circuit,
which reversed and remanded the case to the BIA, finding that it had
ignored potentially significant facts that suggested that the client had
the well-founded fear of future persecution required for a grant of
asylum. On remand, the BIA vacated its earlier ruling, and found that
the client had established his eligibility for asylum, and the
Immigration Judge finally granted him asylum more than five years after
his asylum application was submitted.

Cahill Introduces New Training and Development Program for Incoming Associates

On October 18, 2010, Cahill will welcome associates in the class of
2010 to the firm. During their first week, incoming associates will
participate in a new intensive training and development program designed
to introduce and prepare them for the firm's practice. The program will
include seminars and workshops on writing briefs and legal memoranda,
negotiations, legal research, securities offerings, mergers and
acquisitions, and related areas. This new development program is in
addition to the ongoing legal training and development program for
associates that is conducted throughout the year.
With a little help from its former dean Elena Kagan, Harvard Law
School has edged out Yale Law School in the race for the most Supreme
Court clerks this term. The Court today released the official list of
clerks and their law schools and prior clerkships, confirming what's
been available at Above the Law and elsewhere.
The sitting justices have four clerks each, for a total of 36, but
we're counting the three clerks for the three retired justices, who
often are detailed to other justices and perform equivalent tasks. Of
those 39, Harvard can boast 10 -- including three hired last week by
Kagan -- and Yale has nine. Duke and University of Virginia weigh in at
three each.
